LEGISLATION - DRONE FLIGHT

As of January 1, 2021, the new EU regulations 2019/947 on the flight of drones in all Member States have entered into force. The information on the conditions under which it is possible to fly legally with a drone has been published on the website of the Romanian Aeronautical Authority .

THE MAIN PROVISIONS OF THE NEW LEGISLATION

- Drones are divided into several categories, depending on their weight, as follows: under 250 grams, between 250 grams and 2 kilograms and between 2 and 25 kilograms. Another classification takes into account the specifics of drone flights: Open, Specific and Certified.

- If the operation of unmanned platforms is in the Open category or the Specific category, then the operator of the unmanned platform must register and declare his aircraft but there is no need to travel to AACR. After registration, the operator receives a unique registration number, which must be inscribed, by means of a sticker, on each drone held. A fee of 20 euros is charged for registration. A code will be issued from the platform that will be printed and pasted on the drone by its owner / user.

A drone is only registered if it is used for operations specified in the Certified category.

- Drones weighing less than 250 grams equipped with a camera can be used only after registration in the AACR online platform and respecting several conditions: the maximum altitude is 120 m, the distance is at least 30 m from buildings and people horizontally.

- For drones weighing more than 250 grams, an additional pilot certification must be obtained. This certification is obtained following an online exam at the Romanian Aeronautical Authority. The exam differs depending on the weight / category.

- Flights must be announced by telephone below, and in the case of closer flights, approval must be obtained for the flight in the Specific category.

ONLINE EXAMINATION FOR OPEN A1 / 3 AND A2 CERTIFICATION

The examination platform was activated in order to obtain the remote pilot certificate. This applies to:

- A1 / 3 operation classes - for flights outside the cities

- classes of operations A2 - for flights in cities, with certain limitations

WHAT YOU NEED TO KNOW ABOUT THE ONLINE CERTIFICATION EXAMINATION

It is held online and involves a grid-type exam with only one correct answer. The exam fee is 10 euros and includes one exam and two re-exams.

It includes 40 questions for A1 / 3 certification and 30 questions for A2 certification

To pass the exam, you must answer at least 75% of the questions correctly. If you failed to pass the first exam, you can repeat it in 24 hours.

According to Order no. 1280/2021 of September 30, 2021, issued by the Ministry of Transport and Infrastructure CHAPTER 111 Certifications / Authorizations specific to the field of unmanned aircraft, also available at this address, the online registration of UAS operators is charged with 20 €.

Steps to follow:

- online registration of the operator

- declaration of drones owned by the operator

- training and examination if necessary: 10 euros

After completing these steps, you will receive a unique identification code that you will need to display (as a sticker) on the drone.
